Request for Applications: Choice-Making Among Youth Age 3-11: A Foundation for a Self-Determined Life

The Texas Council for Developmental Disabilities (TCDD) announces the availability of funds for activities to increase opportunities for children with developmental disabilities (DD), families, and others in a child's support network to learn and practice choice making skills. At all ages, children can make choices in their daily routine at home, school, when they play, and how they interact in the community. Choice making has most commonly been referred to as the "selection of an item or activity from an array of options at a particular moment in time". Mastering decision-making skills requires development and consistent practice, and individuals with disabilities too often have limited experience making choices. This initiative aims to develop and demonstrate effective strategies for fostering choice making skills in children aged 3 to 11, laying the groundwork for cultivating the skills of self-determination by the time they reach adolescence. The selection of these age groups is intended to supplement the education and training currently offered to students over the age of 14. Projects should include strategies to educate and train individuals as well as parents, teachers, and others in their support network and provide opportunities for individuals with DD to demonstrate choice making skills in daily routines.

TCDD has approved funding for one organization for up to three years. Funding is approved for up to $300,000 each year. Funds available for this project are provided to TCDD by the Administration for Community Living (ACL), U.S. Department of Health and Human Services, with 100% federal funding pursuant to the Developmental Disabilities Assistance and Bill of Rights Act. Funding for the project is dependent on the results of a review process established by TCDD and on the availability of funds. Non-federal matching funds of at least 25% of total project costs are required for projects. Non-federal matching funds at a reduced rate of 10% of the total project costs are allowed for project activities conducted in federally designated poverty areas.

The Texas Commission on Environmental Quality (TCEQ, agency, or commission) staff is providing an opportunity for written public comment on the listed Agreed Orders (AOs) in accordance with Texas Water Code (TWC), §7.075. TWC, §7.075 requires that before the commission may approve the AOs, the commission shall allow the public an opportunity to submit written comments on the proposed AOs. TWC, §7.075 requires that notice of the proposed orders and the opportunity to comment must be published in the Texas Register no later than the 30th day before the date on which the public comment period closes, which in this case is November 2, 2026. APPLICATION AND PRELIMINARY DECISION. JBM Project, LLC, 1501 South MoPac Expressway, Suite 220, Austin, Texas 78746, which operates Shafter Mine, an underground silver ore mining facility, has applied to the Texas Commission on Environmental Quality (TCEQ) for a renewal of Texas Pollutant Discharge Elimination System (TPDES) Permit No. WQ0004297000, which authorizes the discharge of mine dewatering water at a daily average flow not to exceed 360,000 gallons per day via Outfall 001. The TCEQ received this application on December 10, 2025.

The facility is located at 97423 U.S. Highway 67, southwest of the City of Marfa, Presidio County, Texas 79843. The effluent is discharged to an unnamed tributary, thence to Arroyo del Muerto, thence to Wilson Arroyo, thence to Rio Grande Below Riverside Diversion Dam in Segment No. 2307 of the Rio Grande Basin. The unclassified receiving water uses are minimal aquatic life use for the unnamed tributary and Arroyo del Muerto. The designated uses for Segment No. 2307 are primary contact recreation, public water supply, and high aquatic life use.

The TCEQ Executive Director has completed the technical review of the application and prepared a draft permit. The draft permit, if approved, would establish the conditions under which the facility must operate. The Executive Director has made a preliminary decision that this permit, if issued, meets all statutory and regulatory requirements. OPPORTUNITY FOR A CONTESTED CASE HEARING. After the deadline for public comments, the Executive Director will consider the comments and prepare a response to all relevant and material, or significant public comments. The response to comments, along with the Executive Director's decision on the application, will be mailed to everyone who submitted public comments or who requested to be on a mailing list for this application. If comments are received, the mailing will also provide instructions for requesting a contested case hearing or reconsideration of the Executive Director's decision. A contested case hearing is a legal proceeding similar to a civil trial in a state district court.

TO REQUEST A CONTESTED CASE HEARING, YOU MUST INCLUDE THE FOLLOWING ITEMS IN YOUR REQUEST: your name, address, phone number; applicant's name and proposed permit number; the location and distance of your property/activities relative to the proposed facility; a specific description of how you would be adversely affected by the facility in a way not common to the general public; and the statement "[I/we] request a contested case hearing." If the request for contested case hearing is filed on behalf of a group or association, the request must designate the group's representative for receiving future correspondence; identify an individual member of the group who would be adversely affected by the proposed facility or activity; provide the information discussed above regarding the affected member's location and distance from the facility or activity; explain how and why the member would be affected; and explain how the interests the group seeks to protect are relevant to the group's purpose.

Following the close of all applicable comment and request periods, the Executive Director will forward the application and any requests for reconsideration or for a contested case hearing to the TCEQ Commissioners for their consideration at a scheduled Commission meeting.

The Commission will only grant a contested case hearing on disputed issues of fact that are relevant and material to the Commission's decision on the application. Further, the Commission will only grant a hearing on issues that were raised in timely filed comments that were not subsequently withdrawn. TCEQ may act on an application to renew a permit for discharge of wastewater without providing an opportunity for a contested case hearing if certain criteria are met.

EXECUTIVE DIRECTOR ACTION. The Executive Director may issue final approval of the application unless a timely contested case hearing request or a timely request for reconsideration is filed. If a timely hearing request or request for reconsideration is filed, the Executive Director will not issue final approval of the permit and will forward the application and requests to the TCEQ Commissioners for their consideration at a scheduled Commission meeting.

MAILING LIST. If you submit public comments, a request for a contested case hearing or a reconsideration of the Executive Director's decision, you will be added to the mailing list for this specific application to receive future public notices mailed by the Office of the Chief Clerk. In addition, you may request to be added to: (1) the permanent list for a specific applicant name and permit number; and (2) the mailing list for a specific county. If you wish to be placed on the permanent and the county mailing list, clearly specify which list(s) and send your request to TCEQ Office of the Chief Clerk at the address below.

Application and Draft Permit. Corpus Christi Liquefaction, LLC, P.O. Box 162, Gregory, Texas 78359-0162, a Natural Gas Distribution facility, has applied to the TCEQ for a Renewal of Federal Operating Permit (herein referred to as permit) No. O3580, Application No. 38754 to authorize operation of the Corpus Christi Liquefaction. The area addressed by the application is located at off of State Highway 361, approximately 3 miles southeast of Gregory in Gregory, San Patricio County, Texas 78539. This application was received by the TCEQ on August 13, 2025.

The TCEQ Executive Director has completed the technical review of the application and prepared a draft permit. The draft permit, if approved, will codify the conditions under which the site must operate. The TCEQ Executive Director recommends issuance of the draft permit. The purpose of a federal operating permit is to improve overall compliance with the rules governing air pollution control by clearly listing all applicable requirements, as defined in Title 30 Texas Administrative Code (30 TAC) §122.10. The permit will not authorize new construction or new emissions.

Notice and Comment Hearing. The hearing will be structured for the receipt of oral or written comments by interested persons. Registration and an informal discussion period with commission staff members will begin during the first 30 minutes. During the informal discussion period, the public is encouraged to ask questions and engage in open discussion with the applicant and the TCEQ staff concerning this application and draft permit. Issues raised during this discussion period will only be addressed in the formal response to comments if the issue is also presented during the hearing. After the conclusion of the informal discussion period, the TCEQ will conduct a notice and comment hearing regarding the application and draft permit. Individuals may present oral statements when called upon in order of registration. A reasonable time limit may be established at the hearing to assure that enough time is allowed for every interested person to speak. There will be no open discussion during the hearing. The purpose of this hearing will be to receive formal public comment which the TCEQ will consider in determining whether to revise and/or issue the permit and in determining the accuracy and completeness of the permit. Any person may attend this meeting and submit written or oral comments. The hearing will be conducted in accordance with the Texas Clean Air Act §382.0561, as codified in the Texas Health and Safety Code, and 30 TAC §122.340.

TCEQ Internal Control No. D-07012026-012: HLH Properties, LLC, Texas limited liability company (the "Petitioner"), filed a petition for creation of The Grove Municipal Management District of Medina County (the "District") with the Texas Commission on Environmental Quality (TCEQ). The petition was filed pursuant to Article XVI, Section 59, Article III, Section 52, and Article III, Section 52-a, of the Texas Constitution, and Chapter 375, Texas Local Government Code; and the procedural rules of the TCEQ. Notice of Public Meeting for TPDES Permit for Industrial Wastewater New Permit No. WQ0005502000

APPLICATION. EPCOR NR Holdings Inc., 4801 University Boulevard, Suite 410, Round Rock, Texas 78665, which proposes to operate Bayshore Desalination Facility, a seawater desalination water treatment facility, has applied to the Texas Commission on Environmental Quality (TCEQ) for a new permit, Texas Pollutant Discharge Elimination System (TPDES) Permit No. WQ0005502000, to authorize the discharge of water treatment waste and raw water at a daily average flow not to exceed 59,930,000 gallons per day via Outfall 001. The TCEQ received this application on October 3, 2025.

The facility will be located at 5501 State Highway 146, approximately 1.15 miles southeast of the intersection of State Highway 146 and Farm-to-Market Road 646, near Bacliff, in Galveston County, Texas 77518. The effluent will be discharged via Outfall 001 to the Houston Lighting and Power (HL&P) Canal, thence to Upper Galveston Bay in Segment No. 2421 of the Bays and Estuaries. The unclassified receiving water use is high aquatic life use for the HL&P Canal. The designated uses for Segment No. 2421 are primary contact recreation, high aquatic life use, and oyster waters.

In accordance with Title 30 Texas Administrative Code Section 307.5 and TCEQ's Procedures to Implement the Texas Surface Water Quality Standards (June 2010), an antidegradation review of the receiving waters was performed. A Tier 1 antidegradation review has preliminarily determined that existing water quality uses will not be impaired by this permit action. Numerical and narrative criteria to protect existing uses will be maintained. A Tier 2 review has preliminarily determined that no significant degradation of water quality is expected in HL&P cooling water canal or Upper Galveston Bay, which has been identified as having high aquatic life use. Existing uses will be maintained and protected. The preliminary determination can be reexamined and may be modified if new information is received.

The TCEQ Executive Director reviewed this action for consistency with the Texas Coastal Management Program (CMP) goals and policies in accordance with the regulations of the General Land Office and has determined that the action is consistent with the applicable CMP goals and policies.

The TCEQ Executive Director has completed the technical review of the application and prepared a draft permit. The draft permit, if approved, would establish the conditions under which the facility must operate. The Executive Director has made a preliminary decision that this permit, if issued, meets all statutory and regulatory requirements.

On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439 - 1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC Chapter 26. Requests for federal consistency review were deemed administratively complete for the following project(s) during the period of September 12, 2026 to September 18, 2026. As required by federal law, the public is given an opportunity to comment on the consistency of proposed activities in the coastal zone undertaken or authorized by federal agencies. Pursuant to 31 TAC §§30.20(f), 30.30(h), and 30.40(e), the public comment period extends 30 days from the date published on the Texas General Land Office web site. Applicant: Port of Houston Authority

Location: The project site is located in Old River (San Jacinto River), south of Lost Lake Dredge Material Placement Area (DMPA), at the confluence of the Houston Ship Channel (HSC), and Old River, in Houston, Harris County, Texas.

Project Description: The applicant proposes to expand an existing barge fleeting facility within the confluence of the HSC and Old River (San Jacinto River). The project will include hydraulically or mechanically dredging approximately 570,000 cubic yards of dredged material from 28.5 acres of Old River to a proposed depth of -13.5 feet mean lower low water, plus 1.0-foot of allowable overdredge, and the installation of up to 50 mono-pile dolphins and/or deadmen for the mooring and breasting of barges within the proposed expanded barge fleeting area. Dredge material will be placed into upland contained private DMPAs including East/West Jones, Adloy, Beltway 8 Tract, Stimson Tract, House Tract, Clinton, Laughlin-Thyssin, Greens Bayou, Pinto Lion (Houston Placement Area), Peggy Lake, Lost Lake, Alexander Island, and Spilman Island, depending on capacity and availability. The applicant's purpose is to create (expand) a barge fleeting and staging facility within the upper channel to relieve barge congestion and logistical issues resulting from insufficient regional capacity of the HSC.

The applicant has stated that they have avoided and minimized environmental impacts to waters of the United States associated with the proposed activity by designing the project to avoid and minimize impacts to waters of the U.S., including wetlands, to the greatest extent practicable, while still achieving the needs and purpose of the project. Proposed impacts to wetlands or other special aquatic sites have been avoided. The applicant proposes to avoid the discharge of fill into open waters by placing fill material into upland confined placement areas. The proposed project involves work within a previously disturbed area that is part of a much larger industrial waterbody with high levels of turbidity and degraded environmental value. The applicant has not proposed any compensatory mitigation because adverse impacts to the aquatic environment are not anticipated. The USACE will determine the type and amount of compensatory mitigation necessary to offset losses of waters of the United States which may result from the proposed activity in accordance with 33 CFR § 332.

Type of Application: U.S. Army Corps of Engineers permit application # SWG-2016-00441. This application will be reviewed pursuant Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899. Note: The consistency review for this project may be conducted by The Texas Commission on Environmental Quality as part of its certification under §401 of the Clean Water Act.

CMP Project No: 27-1011-F1

Applicant: Zipline International Inc.

Location: The Houston metropolitan area

Project Description: Zipline is seeking to amend its air carrier Operation Specifications (OpSpecs) and other Federal Aviation Administration (FAA) approvals necessary to begin commercial drone package delivery operations in the Houston Texas metro area. Zipline would primarily construct on existing infrastructure, such as parking lots or the sides of buildings. Zipline is proposing to conduct operations 24 hours a day, 7 days per week, including holidays, using its Zipline unmanned aircraft (UA). The Houston metro area would have 30 - 65 Zipline Chargers, 600 - 1,300 Zipline Dropboxes (i.e., pick up kiosks), and a maximum of 30,000 - 65,000 deliveries and 195,000 transits per day. Each Charger would contain up to a maximum of 72 individual "docks" with charging capability, but most Chargers would have around 36 docks; all docks may not be occupied at any one time. Each Dropbox would have loading capability, where payloads from partners would be received and autonomously retrieved by the Zipline UA.

Approximately 95% of flights would take place during 7:00 a.m. to 10:00 p.m. and 5% of flights would take place during 10:00 p.m. to 7:00 a.m. For each delivery, a Zipline UA would undock from a Charger, fly to a Dropbox to pick up a package, make a delivery, and return to a Charger (not necessarily the same Charger from which it undocked). Zipline UAs are capable of flying up to 20 miles between charges, so each round trip (including all three flights) would be no greater than 20 miles. The estimated total distance flown for deliveries would vary depending upon the Charger, Dropbox, and delivery locations. Charger and Dropbox locations would be determined through partner agreements and market demand; deliveries would likely be distributed throughout the service area of individual Chargers and Dropboxes and would remain within the defined operating areas. In the event that Chargers are installed with overlapping service areas, Zipline would not exceed 1,000 total deliveries per day in the area of overlap. Each delivery would include three transits, but for each delivery a maximum of two transits would fly over any one location on the ground; as a result, there would be no greater than 2,000 maximum transits per day over any ground location in the area of overlap. Zipline UAs would primarily be transporting consumer goods, food and beverages, and pharmaceuticals in partnership with merchants (including pharmacies) in the communities they already serve and would provide an alternative to in-store pick up.

Currently, the Peer Specialist Services Medicaid benefit is available to individuals 21 years of age and older who have a mental health or substance use condition and who have peer specialist services included as a component of their plan of care. Other non-substantive updates have been made to formatting and language.

The proposed amendment is estimated to result in an annual aggregate cost-savings of ($68,830) for federal fiscal year 2027, consisting of ($40,369) in federal funds and ($28,461) in state general revenue. For federal fiscal year 2028, the estimated annual aggregate cost-savings is ($96,401), consisting of ($56,838) in federal funds and ($39,563) in state general revenue. For federal fiscal year 2029, the estimated annual aggregate cost-savings is ($100,996), consisting of ($59,587) in federal funds and ($41,408) in state general revenue.

Pursuant to the Public Utility Regulatory Act, Texas Utilities Code § 13.064, the Office of Public Utility Counsel (OPUC) will conduct its annual public hearing in person, virtually, and via toll-free conference call on:

October 13, 2026, from 1:30 - 3:30 p.m.

OPUC represents residential and small commercial consumers, as a class, in electric, water, wastewater, and telecommunication utility cases and state agency rulemakings in Texas. The meeting will include presentations from OPUC, experts, and key industry stakeholders. Members of the public are welcome to attend and learn about OPUC, how OPUC has advocated for residential and small commercial consumers this past year, and how state government oversees these public utilities and hear directly from utility providers. Those in attendance will be provided an opportunity to offer public comments and ask questions during the meeting.
