Rule Review Plan

In accordance with the Texas Government Code §2001.039, regarding Agency Review of Existing Rules and requiring the Teacher Retirement System of Texas (TRS) and other governmental bodies to review their rules every four years, TRS submits the following rule review plan.

At the September 8 - 9, 2005, meeting of the TRS Board of Trustees (Board), the Policy Committee of the Board considered authorizing for public comment publication a notice of intention to review and to consider for readoption, amendment, or repeal of the above-cited chapters of Title 34, Part 3, Texas Administrative Code (proposed rule review).

Following the September meeting, TRS will file with the Secretary of State for public comment publication in the Texas Register the proposed rule review of Chapter 53 approved by the Policy Committee. The public will have an opportunity to comment on the proposed rule review of Chapter 53 at the November 4, 2005, meeting of the Board and in writing as provided in the proposed rule review to be published in the Texas Register.

At the December 8 - 9, 2005 meeting of the TRS Board, the Policy Committee of the Board will consider authorizing for public comment publication any proposed changes to Chapter 53 following the Board's review of that chapter. The public will have an opportunity to comment on the proposed rule changes in Chapter 53 at the December 2005 meeting of the Policy Committee and the Board and in writing as provided in the notice of proposed rulemaking to be published in the Texas Register.

At the March 2006 meeting of the TRS Board, the Board will consider the recommendation of its Policy Committee regarding the adoption of the completed rule review and any changes to Chapter 53 as a result of the rule review. The public will have an opportunity to comment on the proposed adoption of the completed rule review of Chapter 53 and any changes to the rules resulting from the rule review at the March 2006 meeting of the Policy Committee and the Board.

In approximately March 2006, TRS will file with the Secretary of State for public comment publication in the Texas Register the proposed rule review of all chapters other than Chapter 53, as approved by the Policy Committee at its September 8 - 9, 2005, meeting. The public will have an opportunity to comment on the proposed rule review of these chapters at the June 2006 meeting of the Board and in writing as provided in the proposed rule review to be published in the Texas Register.

At the September 2006 meeting of the TRS Board, the Policy Committee of the Board will consider authorizing for public comment publication any proposed changes to the chapters following the Board's review. The public will have an opportunity to comment on the proposed rule changes at a meeting of the Board in November or December 2006 in writing as provided in the notice of proposed rulemaking to be published in the Texas Register.

At the December 2006 meeting of the TRS Board, the Board will consider the recommendation of its Policy Committee regarding the adoption of the completed rule review and any changes to the rules as a result of the rule review. The public will have an opportunity to comment on the proposed adoption of the completed rule review and any changes to the rules resulting from the rule review at the December 2006 meeting of the Policy Committee and the Board.
