Rule Review Plan

The Texas Commission for the Blind submits this plan for review of its rules in accordance with Government Code 2001.039. The agency filed a plan for reviewing rules in May 1998 in compliance with House Bill 1, Article IX, 167, 75th Legislature, 1997. The plan submitted below supersedes the agency's earlier plan and any timeframes included therein.

The following schedule will be adhered to as closely as possible for reviewing all of the Commission's rules in Title 40 of the Texas Administrative Code. The exact date of the review may shift backward or forward, but not more than one Board meeting. Notice inviting public comments on rules scheduled for review for the purposes specified in 2001.039, Government Code, will be filed approximately 30 days prior to the meeting in which the rules are expected to be reviewed by the Board. For administrative continuity and public convenience, the Commission shall, when practicable, review all rules within a chapter during the chapter's assigned review period regardless of varying effective dates within the chapter.

Changes to rules under review will be proposed through the normal rule-making process and adopted in a subsequent board meeting.

Review of Chapter 159 is scheduled for the Board's February 2003 meeting.

Review of Chapter 161 is scheduled for the Board's November 2001 meeting.

Review of Chapter 162 is scheduled for the Board's May 2001 meeting.

Review of Chapter 163 is scheduled for the Board's November 2000 meeting.
