Title 37, Part 5

The Texas Board of Pardons and Paroles files this notice of readoption of 37 TAC, Part 5, Chapter 141, concerning General Provisions. The Board amended §§141.1 - 141.101 to add capitalization to the titles throughout the rules. Section 141.57 was amended to change the process of reviewing Petitions for Adoption of Rule, which requires the General Counsel to consult with the Presiding Officer who will make a final decision on the disposition of the Petition. Section 141.60 and §141.61 were amended to reflect the two- to six-month time frames for discretionary mandatory supervision. Section 141.71 was amended to clean up language relating to minutes of the Board. Section 141.82 was amended to provide clarity for the attorneys as it relates to the fee affidavit and the interview. Section 141.91 was amended to provide attorneys instructions of when to contact a Board Office for an interview. Section 141.111 was amended to add three new definitions: (14) Eligible inmate, (19) Initial review, and (39) Review period, and to correct clerical errors. The readoption of Chapter 141 is filed in accordance with the Board of Pardons and Paroles' Notice of Intent to Review published in the May 5, 2017, issue of the Texas Register (42 TexReg 2417). No public comments were received.

The assessment of Chapter 141 indicates that the original justifications for these rules continue to exist, and the Board is readopting the rules in accordance with Texas Government Code, §2001.039. This concludes the review of 37 TAC Chapter 141.
