Texas State Board of Plumbing Examiners

Title 22, Part 17

Pursuant to the Notice of Proposed Rule Review published in the November 25, 2016, issue of the Texas Register (41 TexReg 9343), The Texas State Board of Plumbing Examiners (Board) has reviewed Texas Administrative Code, Title 22, Part 17, Chapter 365, concerning Licensing and Registration. The Board did not receive any comments in response to this notice.

As a result of the review, the Board has determined that the reasons for initially adopting Chapter 365 continue to exist, and that amendments to §§365.1, 365.2, 365.4 - 365.8, 365.10, and 365.13 are necessary. The Board has decided to repeal §365.9 in its entirety because it is duplicative of 22 Tex. Admin. Code §367.11. The proposed amendments to §§365.1, 365.2, 365.4 - 365.8, 365.10, and 365.13 and proposed repeal of §365.9 are being concurrently published for public comment in the Proposed Rules section of this issue of the Texas Register.

In addition, the Board has determined that §365.14 should be restructured and divided into eight separate rules to improve clarity and make it more accessible to the public, and a new rule addressing continuing education courses for licensees with a Medical Gas Piping Installation Endorsement should be adopted. Because these changes entail renumbering several sections, it is necessary to repeal the existing versions of §§365.14 - 365.17 in their entirety and replace them with new versions. The repeal and proposed new versions of §§365.14 - 365.17, along with the proposed new §§365.18 - 365.23, are being concurrently published for public comment in the Proposed Rules section of this issue of the Texas Register.

Subject to the proposed repeals and amendments, the Board readopts each rule in Texas Administrative Code, Title 22, Part 17, Chapter 365 in accordance with the requirements of section 2001.039 of the Texas Government Code. This concludes the review of Texas Administrative Code, Title 22, Part 17, Chapter 365.
