| RE: | Waiver of Partial Manual Count for Elections Held on November 2, 2010 by Political Subdivisions Other Than Counties |
Under Section 127.201(a) of the Texas Election Code (the “Code”), the general custodian of election records, in an election in which an electronic voting system is used, is required to conduct a manual count in one percent of the election precincts or three election precincts, whichever is greater. Tex. Elec. Code Ann. § 127.201(a) (Vernon Supp. 2010). However, Section 127.201(f) of the Code gives the Secretary of State authority to waive this requirement. This is your official notification that the partial manual count will be waived for any November 2, 2010 elections conducted by political subdivisions other than counties.
