RE: Recount Deadlines For November 2, 2010 Election for Federal, State and County Officers

Below are the deadlines for filing a recount in county and precinct races, statewide and district races and expedited situation such as an impending runoff. (Recount deadlines for elections conducted by cities, schools and other political subdivisions may be found at this memo.) The deadline to request a recount for a county or precinct office on the November 2, 2010 ballot is 5:00 p.m. of the 2nd day after the canvass is actually conducted, as follows:

Statewide and District Races

The deadline to request a recount for a statewide or district office is 5:00 p.m. of the second day after the final canvass. The final state canvass date for the general election has not been set at press time, so those deadlines cannot yet be determined. However, state law requires that the state canvass be conducted no earlier than the 15th day and no later than the 30th day after the election.

Expedited Deadline (for special elections and local elections with majority vote requirement)

Please note that the deadline to request a recount when a majority vote is required AND there were more than two candidates for the office, is the later of 2:00 p.m. of the third day after election day or 2:00 p.m. of the first day after the date of the local canvass. If the deadline falls on a Saturday, Sunday or legal state holiday, the deadline is extended to 10:00 a.m. of the next business day. Please note that the expedited process will not apply to the November 2, 2010 General Election for State and County Officers (since there are no majority vote races), but may apply to a local election (e.g., city, school, water districts) or special elections to fill a vacancy in the legislature which you may be conducting on the November ballot.
