RE: New Forms and Changes to Existing Forms

Election Advisory No. 2009-08, issued on July 9, 2009, described the election-related changes that were adopted by the 81st Legislature in Regular Session this year.  This Advisory explains the required changes to existing forms and a few new forms that are required as a result of this new legislation.  All new forms are identified by form number and title and may be accessed from our webpage at the following link, under Conducting Your Elections:

New Forms

VOTER COMPLAINT INFORMATION  AW 7-9a (PDF, 404k)
House Bill 1256 requires a new notice to be posted in the polling place advising voters whom to contact if they have a complaint about the election.  The election judge is required to post the sign inside the polling place in an area visible to voters.  At least one sign must be posted, but more than one is permissible.  The title of the poster is required to be in 100-point Times New Roman font.

REQUEST FOR OMISSION  B9-2W (PDF, 19k)
Senate Bill 281 allows judges and their spouses to request their voter registration information be redacted and not part of public information.  The Request for Omission is filed with the Voter Registrar.

NOTICE OF DEADLINE TO FILE APPLICATIONS FOR PLACE ON THE BALLOT  AW 3-2a (PDF, 17k)
Pursuant to Senate Bill 1970, the authority who receives applications for place on the ballot must post not later than the 30th day before the first day to file an application for place on the ballot a notice where applications can be received, along with the dates for filing.  Notice is posted on bulletin board where the governmental body posts notices of open meetings.

Revised Forms

ORDER OF MUNICIPAL ELECTION  AW 1-2 (PDF, 30k), ORDER OF ELECTION FOR OTHER POLITICAL SUBDIVISIONS AW 1-3 (PDF, 20k)
Pursuant to House Bill 3069, these forms were changed to include an instruction note that a copy of the order must be filed with the County Clerk/Elections Administrator and Voter Registrar not later than 60 days before the election.

ORDER OF SPECIAL ELECTION FOR MUNICIPALITIES  AW 1-6 (PDF, 24k)
Pursuant to House Bill 3069, this form was revised to include instruction note that a copy of this order had to be filed with the County Clerk/Elections Administrator and Voter Registrar immediately after ordering the election.

NOTICE OF GENERAL ELECTION  AW 1-7 (PDF, 28k), NOTICE FOR GENERAL ELECTIONS FOR ALL OTHER POLITICAL SUBDIVISIONS  AW 1-11 9/2009 (PDF, 24k)
Form changed to include notice of all branch locations for early voting, along with dates and hours voting will be conducted at those locations as required by Senate Bill 1970.

NOTICE OF SPECIAL ELECTION AW 1-8 (PDF, 24k) 9/2009
Form changed to include notice of all branch locations for early voting, along with dates and hours voting will be conducted at those locations as required by Senate Bill 1970.

PROVISIONAL BALLOT ENVELOPE AW 7-15 (PDF, 27k) 9/2009
Since the provisional ballot envelope also serves as an application for voter registration, the provisional ballot affidavit was changed to reflect the same changes that were made on the voter registration application pursuant to House Bill 1448.  The boxes to indicate that a voter has not been issued a driver’s  license number or social security number have been consolidated.

NOTICE TO PROVISIONAL VOTER AW 7-15a (PDF 15k)
Revised to reflect proper canvass dates.

LIST OF ID VOTERS AW 7-27a (PDF, 24k)
This form added an additional instruction to the judge, and the name of the form was changed to reflect proper use of the form.

APPLICATION FOR LIMITED BALLOT AW 5-28 (PDF, 39k)
Since the application for limited ballot serves as an application for voter registration, the application was changed to reflect the same changes that were made on the voter registration application pursuant to House Bill 1448.  The boxes to indicate that a voter has not been issued a driver’s license number or social security number have been consolidated.

Revised Forms for use by County Voter Registrar Only

STATEMENT OF RESIDENCE A 7-14 Ind (PDF, 107k)
Since the statement of residence form also serves as an application for voter registration, the application was changed to reflect the same changes that were made on the voter registration application pursuant to House Bill 1448.  The boxes to indicate that a voter has not been issued a driver’s license number or social security number have been consolidated.
Additional statements were added to the statement of residence form in the event the new address provided on the statement of residence is in a Texas county other than the one in which the voter is offering to vote.  The voter registrar can use that statement to cancel the voter’s record, copy the statement for record, and forward the statement to the voter registrar in the new county.  The new county voter registrar will be able to use the statement as a voter registration application.

ADDRESS CONFIRMATION NOTICE AND RESPONSE FORM BW 5-1 (PDF, 18k), B5-2c40 (PDF, 110k), B5-2b.ind3 (PDF, 343k)
The address confirmation notice was changed to inform the voter if he or she completes the response form and indicates that he or she no longer lives in the county, then the voter registrar will forward the response form to the voter registrar in the new county of residence who will be able to use it as a voter registration application in the voter’s new county.

Address confirmation response form was also changed to reflect the new law in House Bill 1448 regarding the statement that a person has to make on a voter registration application concerning whether the person has been issued a driver’s license or social security number.  The boxes to indicate that a voter has not been issued a driver’s license number or social security number have been consolidated.

Additional statements were added to the address confirmation response form in the event the voter responds and provides a new residence address in a Texas county other than the one in which the voter is currently registered to vote.  The voter registrar can use the response form to cancel the voter’s record, copy the response form for record, and forward the response form to the voter registrar in the new county.  The new county voter registrar will be able to use the response form as a voter registration application.

There are two designs of address confirmation notice and response.  One form has both notice and response on the same piece of paper and is designed as a tri-fold form.

NOTICE TO VOTER TO PROVIDE ID WHEN VOTING BY MAIL AW 5-22a (PDF, 19k)
The title of this form was changed to better reflect its purpose and was also reformatted slightly.

NOTICE OF CANCELLATION BW 5-3 (PDF, 32k) 7/09
This form was changed to reflect verbiage that was changed in 2007 regarding persons who are declared totally mentally incapacitated.  This form is used only by the Voter Registrar.

NOTICE OF IDENTIFICATION REQUIRED BW 1-3a (PDF, 17k)
This form is used to notify a voter that his or her identification could not be verified when registering to vote and that the voter will be required to present additional identification when voting for the first time after registering.  These voters are flagged ID on the list of registered voters.  The voter registrar sends this notice when mailing the original voter registration certificate.
