First day candidates may file declaration of write-in candidacy for county or precinct chair. Tex. Elec. Code Ann. §§ 146.025, 171.0231(d) & (e).

Note: This start date for filing a write-in declaration by candidates for county or precinct chairs, and the deadline for filing such a declaration, results from a strict application of the statutes. It is recognized that it makes little sense for a write-in period to be contained within the regular filing period.

First day Democratic or Republican party candidate may file an application for a place on the primary ballot. Tex. Elec. Code Ann. § 172.023(b).

Note: The statutes do not provide a start date for other party candidates to file applications to be nominated by convention.  See Tex. Elec. Code Ann. § 181.031(b).

First day independent candidates may file declaration of intent to run. Tex. Elec. Code Ann. §§ 142.002(b), 172.023(b).

Last day for a candidate to withdraw from the primary ballot. Tex. Elec. Code Ann. § 172.052.

If a candidate dies or is declared ineligible by this date, the name is omitted from the ballot.  Tex. Elec. Code Ann. §§ 172.057, 172.058.

Last day a vacancy for an unexpired term may occur and appear on the primary ballot.  Tex. Elec. Code Ann. § 202.004(a).

Last day candidates may file a declaration of write-in candidacy for county or precinct chair (5 p.m.).  Tex. Elec. Code Ann. § 171.0231(d).

Note:    The dates to extend filing deadlines for candidates, who have filed applications and have withdrawn, been declared ineligible, or have died, are not applicable for this election.  The extended deadline pursuant to Section 172.054 of the Texas Election Code would fall before the new extended regular filing deadline of January 4, 2010.  This is also true for candidates for party chair positions.

Note:    If vacancies occur in an office that is not regularly-scheduled for election on or before December 30, 2009, the deadline to file for office is also January 4, 2010 since the extended deadline pursuant to Section 202.004 of the Texas Election Code is earlier than the regular filing deadline of January 4, 2010.

Note:    The statutory deadline of the 57th day falls on the extended January 4 filing deadline and is therefore not feasible for full compliance; in response SOS has proposed an administrative rule Section 81.136 so that he deadline may fall on January 6.
